Terms and conditions for Divinia Travel's advisory and booking services.

As a travel advisor, we provide guidance, consultation, and booking services for cruises, customized trips, all-inclusive resorts, and other travel-related services. We act as an intermediary between the client and travel suppliers, such as cruise lines, airlines, hotels, and tour operators. We are not the source or provider of the travel services themselves.
By using our services, you represent that you are at least 18 years of age and possess the legal authority to enter into agreements and make travel bookings on behalf of yourself and any members of your traveling party. You warrant that all information you provide to us is true, accurate, and complete.
All payments for travel services are made directly to the travel suppliers. We do not process payments ourselves, but we assist with the booking and ensure that the payment process is seamless. Payment terms, including deposit requirements, payment plans, and final payment deadlines, are determined by the travel supplier and will be communicated to the client during the booking process. Failure to make final payment by the supplier's deadline may result in cancellation of reservations and forfeiture of amounts paid.
Our services are offered at no additional cost to the client. We are compensated through commissions that are included in the price of the services provided by travel suppliers. The client will not pay extra fees for using our services. Any changes to pricing due to additional services requested by the client or adjustments made by the travel supplier may result in updated fees.
Cancellations and modifications to bookings are subject to the policies of the respective travel suppliers. We will assist clients with the process, but the client is responsible for understanding and adhering to the supplier's cancellation and modification terms, which may include fees or penalties. In some cases there is no refund once a booking is made and a deposit is received. All cancellation requests should be submitted to us in writing.
When tour, cruise, or package prices are based on supplier contract rates, the client will not be entitled to any refund for any unused portion of travel arrangements. Some group tours are based on a minimum number of passengers; if the minimum is not met, a surcharge may be imposed or the tour may be canceled per the operator's cancellation policy.
We strongly recommend that all clients purchase travel insurance to cover potential risks such as trip cancellations, delays, medical emergencies, and lost luggage. We can provide information on available travel insurance options but are not responsible for the terms, coverage decisions, or claims processes related to any policy. We are independent travel advisors, not licensed insurance agents. For specific policy details and exclusions, please contact the insurance provider directly. If you decline travel insurance, you acknowledge and accept full liability for any cancellation penalties, damages, or out-of-pocket expenses incurred.
It is the client's sole responsibility to ensure that all travelers in their party have the correct, valid travel documentation required for their destinations, including passports (valid for at least six months beyond the return date), visas, vaccination certificates, and any other entry requirements. We will provide general guidance, but clients must verify that all travel documents are in order before departure. Requirements are subject to change; we recommend consulting travel.state.gov for current requirements.
Travel health and safety requirements vary by destination and are subject to change. It is the client's responsibility to research and comply with all vaccination, health screening, and entry requirements for their destination prior to departure. For health information, we recommend consulting the Centers for Disease Control at cdc.gov/travel. We are not responsible for denied boarding or entry resulting from failure to meet health or documentation requirements.
While we will make every effort to accommodate special requests such as dietary needs, room preferences, and accessibility needs, we cannot guarantee the fulfillment of these requests as they are subject to availability and the policies of the travel suppliers.
All price quotes are applicable to the date and time at which they are provided and are not guaranteed until a booking is confirmed and a deposit is received. Rates are subject to change without notice prior to confirmation. After booking, prices may be subject to supplemental increases imposed by the supplier or government, including but not limited to fuel surcharges, port fees, and government taxes. We will notify you of any such changes as soon as we are made aware of them.
We act solely as an intermediary between clients and travel suppliers and are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any travel supplier or for any personal injuries, death, property damage, or other damages or expenses resulting from supplier actions. Our liability in any circumstance is limited to the fees, if any, paid directly to us for our services.
You agree to indemnify, defend, and hold harmless Divinia Travel and Zeorm, LLC, and their officers, employees, and agents, from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of another party.
We are not liable for any failure or delay in performance of our obligations caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, civil unrest, strikes, or other circumstances beyond the control of travel suppliers or ourselves. In such events, the policies of the relevant travel suppliers will govern refunds and rebooking options.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
